Tariff
(1) After the Commission examines the application in accordance with Section 12, the Commission shall determine the fee according to the fee rate proposed by the applicant or with amendments within sixty days from the date of submission of the application. However, the commission will not determine the tariff in such a way that the tariff rate proposed by the petitioner differs by more than twenty percent.
(2) In accordance with sub-section (1), the Commission shall also specify the date on which the fixed or changed rate will come into force when determining the tariff.
(3) In determining the fee according to sub-section (1), in addition to the basis according to section 10 and 11, the Commission shall make the basis for determining the fee in the case of the service provider who operates the service by obtaining a license or making a contract in accordance with the prevailing law. (4) Before determining the tariff according to sub-section (1), the Commission shall publish a public notice of the proposed tariff rate as prescribed.
(5) After the publication of the notice as per sub-section (4), if any suggestion or response is received from the consumer regarding the proposed tariff rate, the Commission may consider such suggestion as the basis for tariff determination after consulting with the representatives of consumer organizations.
(6) If a person buys or sells bulk water (bulk water supply) to a service provider or a service provider to a person for drinking water or sanitation services, the purchase or sale price of the water to be purchased or sold shall be approved by the Commission.
(7) Notwithstanding anything else written in this section, the commission may determine different tariffs for consumers who buy lump sum water and ordinary consumers.
(8) Other procedures related to fee determination shall be as prescribed.
